Who we are
Back To Joy is the private psychotherapy practice of Flor Villagran, a licensed mental health therapist providing bilingual (English / Spanish) telehealth to adults in New York, Utah, Virginia, Pennsylvania, and Massachusetts.
How we may use and disclose your PHI
Treatment. To provide, coordinate, or manage your mental health care — including, with your written authorization, consultation with other providers you are working with.
Payment. To generate superbills or verify benefits when you request out-of-network reimbursement. We do not submit claims to insurance on your behalf.
Health care operations. Scheduling, record-keeping, quality review, and business functions necessary to run the practice.
Uses and disclosures that require your written authorization
- Most uses and disclosures of psychotherapy notes.
- Uses and disclosures for marketing purposes.
- Sales of PHI.
- Disclosures to third parties you name (family, friends, other providers).
You may revoke a written authorization at any time, in writing, except to the extent we have already acted in reliance on it.
Uses and disclosures permitted or required without your authorization
- When required by law, court order, or a valid subpoena that meets legal requirements.
- To prevent a serious and imminent threat to your health or safety or that of another identifiable person or the public.
- To report suspected abuse, neglect, or exploitation of a child, elder, or dependent adult, as required by state law.
- For health oversight activities authorized by law, and to coroners, medical examiners, or funeral directors as permitted by law.
Your rights
- Request access to and a copy of your clinical record.
- Request an amendment to your record if you believe it is inaccurate.
- Request an accounting of certain disclosures we have made.
- Request restrictions on how we use or disclose your PHI (we will accommodate reasonable requests where feasible).
- Request confidential communications by alternate means or location.
- Receive a paper copy of this Notice at any time.
- File a complaint if you believe your privacy rights have been violated.
Our duties
We are required by law to maintain the privacy of your PHI, provide you with this Notice, abide by its terms, and notify you if a breach of your unsecured PHI occurs. We reserve the right to change this Notice; the revised Notice will apply to all information we maintain and will be posted on this page.
Complaints
You may file a complaint with the practice by emailing florvillagran@gmail.com or with the U.S. Department of Health and Human Services, Office for Civil Rights at hhs.gov/ocr/complaints. You will not be retaliated against for filing a complaint.
